These Terms and Conditions regulate the download, access and use of the Near Him mobile application (hereinafter, the "APP"), available to users on the Apple App Store (iOS). The user acquires this condition by downloading and using the application. By accessing the APP, the user acknowledges having accepted and consented unreservedly to these terms of use and privacy policy.
1. Responsible for the App
Near Him (hereinafter "Near Him") is the owner and responsible for the APP. For any communication, please contact us via our contact page.
2. Object
The APP has been developed to provide users, in a simple and focused way, with daily spiritual reflection content — including Scripture-inspired quotes, breathing exercises, and session tracking — accessible through their mobile devices.
3. Compatible Devices
Near Him is available exclusively on the Apple App Store (iOS). The user acknowledges and agrees to comply with all applicable terms and conditions set by Apple regarding the download and use of the APP. Apple's terms are available at: https://www.apple.com/legal/internet-services/itunes/.
4. Getting Started
When starting the APP for the first time, the user will go through an onboarding flow asking a few optional questions (such as their first name and spiritual goals) to personalise the experience. Users can also configure how often and at what times they wish to receive daily reminders on their device. All this information can be modified at any time through the settings available in the APP.
Once onboarding is completed, the user has access to a free trial period. To continue enjoying the APP after the trial, the user must subscribe to a Premium plan (weekly or yearly) through Apple's in-app purchase system.
5. Method of Use
When opening the APP, the user accesses a home screen where they can start their daily session — a curated sequence of 5 spiritual quotes with a breathing warmup. Users can save favourite quotes and track their daily streak.
5.1 Settings
Through the profile icon, users can access the settings panel to modify their name, notification preferences, session reminder time, and manage their subscription.
5.2 Notifications
According to the frequency and time window chosen by the user, the APP will send push notifications with short inspiring quotes. The user can enable or disable these at any time in their device settings.
6. Intellectual and Industrial Property Rights
All intellectual and industrial property rights over the APP — including its design, content, quotes, code, and graphics — are owned by Near Him, which holds exclusive rights to exploit them in any form, including reproduction, distribution, public communication and transformation.
The user acknowledges that reproduction, modification, distribution, decompilation, reverse engineering, or any unauthorised use of any element of the APP constitutes an infringement of Near Him's intellectual property rights, and undertakes not to carry out any of the aforementioned actions.
7. Privacy Policy
Near Him is committed to protecting your privacy. This section explains how we collect, use, and safeguard your information when you use the APP.
7.1 What data do we process?
Near Him processes the following categories of data:
- Data provided by the user: First name (optional), entered during onboarding. This is stored locally on your device only and is never transmitted to our servers.
- Preferences and usage data: Your notification settings, session history, streak data, and saved favourites are stored locally on your device via AsyncStorage.
- Anonymous analytics: We collect anonymised usage data (screens viewed, session completion, feature interactions) through PostHog to understand how users interact with the APP and improve the experience. No personally identifiable information is attached to these events.
- Subscription data: Managed entirely by RevenueCat and Apple. Near Him does not store your payment information.
- Device and technical data: We may automatically collect technical information such as device type, operating system, and app version for diagnostics and performance monitoring.

7.3 Purposes and Legal Basis
Your data is processed for the following purposes:
- To provide and personalise the APP experience (legal basis: performance of the service).
- To improve the APP through anonymous usage analytics (legal basis: legitimate interest).
- To manage your subscription (legal basis: performance of the contract).
- To send push notifications according to your preferences (legal basis: your consent, which can be withdrawn at any time in device settings).
We retain your data for no longer than necessary for the above purposes. Locally stored data remains on your device until the APP is uninstalled.
7.4 Minors
The APP is intended for users aged 13 and over. Near Him does not knowingly collect personal data from children under 13. If we become aware that a minor is using the APP, we will take appropriate action.
7.5 Third-Party Processors
Near Him uses the following third-party services, which may process certain data as described:
- RevenueCat — subscription management (United States). Privacy Policy

- Apple App Store — app distribution and payment processing. Privacy Policy
By accepting these Terms, you consent to your data being processed by the above services in accordance with their respective privacy policies.
7.6 Exercise of Rights

7.7 Security
Near Him adopts appropriate technical and organisational measures to ensure the security of your data. All communications between the APP and third-party services are encrypted via HTTPS.
7.8 Changes to the Privacy Policy
Near Him may update this Privacy Policy at any time. An updated version will always be available on this page. Continued use of the APP after changes constitutes acceptance of the updated policy.
8. Responsibility
Near Him will at all times try to provide the service with the highest possible quality. Notwithstanding the foregoing, Near Him disclaims any liability for failures, interruptions or damages caused by system failures, viruses, third-party interference, or circumstances beyond its control.
Near Him is not responsible for any loss or damage arising from improper use of the APP by users. Responsibility for use of the APP rests solely with the user.
If you are dissatisfied with the APP or any part of these Terms, your sole remedy is to cease using the APP and cancel your subscription.
9. Nullity and Ineffectiveness of Clauses
If any clause of these Terms is declared null or ineffective, such nullity shall only affect that specific provision. The remaining Terms shall remain in full force and effect.
10. Applicable Law and Jurisdiction
These Terms are governed by applicable law. For individual users, disputes will be resolved in accordance with the applicable law and jurisdiction of the user's country of residence.
